The United States has taken action against Cloudera Inc., a California-based technology company, prohibiting it from sponsoring employment-based green cards for two years. This decision follows a $2 million settlement reached with the US Department of Justice and Department of Labour regarding allegations of discrimination against qualified American workers. The Justice Department's lawsuit, filed in April, claimed Cloudera violated the Immigration and Nationality Act during recruitment for seven positions under the Permanent Labour Certification (PERM) program. As part of the settlement, Cloudera will establish a $1.4 million fund to compensate affected US workers and pay $600,000 in civil penalties. Officials warn this case sets a precedent, signaling increased scrutiny of employers and potential consequences for those found discriminating against American workers in green card sponsorship. This debarment significantly impacts Cloudera’s ability to sponsor foreign employees and serves as a warning to other companies utilizing the PERM program.
