The Supreme Court of Pakistan has ruled it lacks the authority to hear bail applications related to pending National Accountability Bureau (NAB) appeals. In a 30-page judgement, Justice Muhammad Ali Mazhar stated that jurisdiction falls under Article 175F(a) of the Constitution and Sections 32 & 32-A of the National Accountability Ordinance, 1999, transferring such cases to the Federal Constitutional Court (FCC). The decision arose from two petitions: one by NAB challenging an acquittal, and another by an under-trial prisoner seeking post-arrest bail. This ruling settles a jurisdictional dispute regarding NAB cases and clarifies the proper court for addressing bail requests within these appeals. Consequently, all currently pending criminal appeals of this nature will now be processed by the FCC. The three-judge bench, led by Justice Mazhar, delivered the unanimous decision.
