Senegal’s Constitutional Council has ruled on a law modifying article 118 of the internal rules of the Assemblée nationale (National Assembly). The Council validated the referral from the President of the Republic and the adoption procedure of the organic law. However, several provisions concerning the loss of parliamentary mandate were struck down. The decision, number 8/C/2026 dated September 7, 2026, followed a review initiated by the President. The law was originally adopted on May 8, 2026, with 127 votes in favor, 3 against, and 2 abstentions, within the 165-member Assemblée nationale. The Council determined that the National Assembly’s internal rules cannot independently create grounds for losing a parliamentary mandate without specific legal basis in the fundamental law, thus overturning a provision related to absences. Additionally, the phrase "constatation de démission d’office" (finding of automatic resignation) was deemed unconstitutional. Other provisions of the law were upheld, with a caveat regarding absences of deputies.
