A partial dismissal of charges has been issued in the case involving Pape Salif Raal Thiam, Cheikh Ahmed Tidiane Diallo (Pape Cheikh Diallo) and others, according to a statement from the Pikine-Guédiawaye High Court Prosecutor’s office. The investigating judge ordered a non-place – a dismissal – for 28 of the accused, while 71 will be sent to the criminal court for charges related to criminal association and unnatural acts. Charges of endangering the lives of others and intentional transmission of HIV/AIDS were dropped for all involved. Public Prosecutor Saliou Dicko has appealed the judge’s decision, disagreeing with the partial dismissal. This appeal means the case will now proceed to the Dakar Court of Appeal before any trial at the criminal court can begin. The Prosecutor originally sought the referral of all defendants on all charges.
