Portugal’s communications regulator, INCM, has approved new rules governing the sending of Application-to-Person (A2P) SMS messages, including promotional, informational, and authentication texts. The resolution, published June 3rd, will take effect 60 days after publication, addressing a rise in unauthorized mass advertising, particularly related to gambling and fraudulent schemes. Key provisions require explicit “opt-in” consent for promotional messages and a simple, free “opt-out” mechanism for users to block unwanted texts. Telecom operators are mandated to block irregular mass mailings and suspend numbers violating the new regulations. Violators face administrative sanctions, potentially including service blockage. The INCM anticipates these measures will reduce spam, enhance user security, and improve traceability of electronic communications. The aim is to bolster user trust and protect privacy in the face of increasing unsolicited messages.
