Judge Indira Talwani cited a high probability of voter disenfranchisement if the plans were to proceed, as states are legally obligated to send out millions of ballots by a certain deadline and cannot significantly alter procedures this late in the election cycle. The ruling follows a request from the Trump administration to the Supreme Court to overturn Talwani’s initial injunction, a request that remains pending. The administration has also announced plans to appeal to the Court of Appeals. With states already beginning to mail ballots – North Carolina has already begun – time is running out to make substantial changes to voting procedures. The midterm elections are crucial for President Trump, who aims to maintain Republican control of Congress, as a loss of majority would hinder his legislative agenda.
