The American prediction site Polymarket is taking legal action to challenge a ban imposed in the Netherlands. In February, the Nederlandse Kansspelautoriteit (Ksa) ordered Polymarket to cease operations within the Netherlands, deeming it an unlicensed gambling site. Despite ultimately complying and halting its activities, Polymarket was still required to pay a 420,000 euro fine for continued operation after the initial ruling. The company now argues in court that it operates as a financial product, similar to futures contracts, and should therefore fall under the jurisdiction of the Autoriteit Financiële Markten (AFM), not the Ksa. Critics contend the site resembles binary options, a high-risk investment banned in many European countries, where investors either win a fixed amount or lose their entire stake. Polymarket is already prohibited in countries including France and Germany, and it is unclear if legal challenges are underway in those locations as well.
