Election lawyer Romulo Macalintal has escalated his opposition to the postponement of the Barangay and Sangguniang Kabataan Elections (BSKE) in the Philippines, filing a new legal case with the Supreme Court (SC) in Manila. Macalintal is seeking a declaration that Republic Act 12326, the law responsible for delaying the BSKE, is unconstitutional. The lawsuit specifically aims to halt the deferral of this year’s elections. Beyond postponing the elections, RA 12326 also extends the terms of current barangay and Sangguniang Kabataan officials. This move by Macalintal represents a renewed effort to ensure the timely holding of local elections as originally scheduled. The legal challenge argues against the disruption of the democratic process inherent in delaying the BSKE and extending terms without a new mandate from voters. The Supreme Court will now review the petition and determine the constitutionality of the law.
