The Islamabad High Court (IHC) has temporarily halted a National Highway Authority (NHA) notification imposing a 50% toll increase on vehicles lacking an M-Tag or with insufficient funds in their accounts. The suspension follows a petition by advocate Muhammad Jalal Haider questioning the legality of the May 30th NHA directive. The petitioner argues the NHA Act of 1991 does not grant the authority power to impose penalties or surcharges, only to collect tolls. The court has requested a report and response from the federation and NHA within two weeks, adjourning the case to August 3rd. The lawyer for the petitioner claims the extra charge is essentially a penalty without legal basis, exceeding the power granted by the original legislation. The court’s interim order prevents the increased toll from being enforced until further proceedings.
